Supply of Products

Buyers: To buy wine via the website, the buyer must be at least 18 years of age, be located within Australia and specify a delivery address within Australia. Under law, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over. By placing an order, the buyer confirms they are at least 18 years of age. If buying wine as a gift, the recipient must also be at least 18 years of age. The courier will request some form of ID if there is any doubt about the age of the recipient on delivery. If that recipient is unable to produce appropriate ID, the courier cannot leave the wine.

Special offers: At any time, WeLoveVino may terminate any special offer without advance notice.Gift Cards: Each promotional Gift Card may only be redeemed once per household. Gift Cards may not be redeemed on any other Wine that WeLoveVino does not sell. Gift Cards may not be used in conjunction with any other Gift Cards - strict limit of one Gift Card per order.

Prices: Prices stated are in Australian dollars, and are per case, as stated. Prices include GST, unless otherwise stated. All delivery charges are extra, and not included in stated prices. GST:The Buyer's obligation to pay GST on the goods or services that are taxable supplies is subject to WeLoveVino's providing a tax invoice for those goods or services.From the introduction of the GST in Australia on July 1, 2000 WeLoveVino have adjusted the prices at GST of 10%. The prices displayed are inclusive of GST.

Payment: A buyer must pay for an order by Paypal or Credit card when ordering. If the credit card issuer does not authorise the transaction, or later revokes authorisation for the transaction, WeLoveVino may cancel the order.

Pricing errors: If a product inadvertently appears on the website at the wrong price, WeLoveVino may decline or cancel any orders placed at the wrong price, even if the order has been confirmed and a credit card charged. If a credit card was charged for the purchase and the order is so cancelled, WeLoveVino will notify the buyer and issue a credit to the credit card account in the amount of the wrong price.

Product availability: All product is offered for sale on the basis of while stocks last. If a product is out of stock, WeLoveVino may substitute wines of at least equal quality. The "Customer Promise" (see later) covers all wines supplied, so if the substituted wine is not acceptable, the buyer need not pay for that wine.

Delivery: We ship wine to most places within Australia. Most orders will be delivered to your door, however some rural or remote areas will have delivery to the nearest depot.WeLoveVino endeavour to deliver wine to Australian capital city metropolitan areas within 5-6 working days. For delivery addresses in Australian regional centers and outside metropolitan capital cities, allow at least 14 working days. In outlying areas, delivery will be may take a little longer. WeLoveVino do not however guarantee any specific delivery date.Wine is normally delivered Monday to Friday 9.00 am to 5.00 pm and to either business premises or a residence. If the premises are unattended, the wine will not be left but rather the courier will leave a card and the buyer needs to arrange delivery to an attended address.

Breakages: If a case of wine is received with one or more broken bottles, WeLoveVino will issue a credit or send replacement bottles if the buyer so notifies WeLoveVino within 30 days of the date of the invoice.

Risk: Risk of damage, loss or deterioration to product passes to the buyer on delivery.

Title: Product remains WeLoveVino's property until paid for by the buyer.

Customer Promise: If WeLoveVino reasonably believe that a buyer has breached these terms and conditions, or has abused the Customer Promise, WeLoveVino may suspend or cancel the Customer Promise in relation to that buyer, cancel a particular order made by the buyer or close that buyer's account.

Cancellations: A buyer may for any reason cancel their order at any time up to 7 working days after the date the wine is received by so notifying WeLoveVino and provided the bottles are unopened and in original saleable condition.

Returns: Where wine is to be returned, WeLoveVino will collect the wine from the buyer at a mutually convenient time. Pending collection, the buyer is liable to keep the wine in a safe and proper manner and take reasonable care of it. Wine should be returned in the original box and packed to avoid breakage in transit back to WeLoveVino.

Refunds: Any price refunds will be effected within 30 days after WeLoveVino was notified of the reason, conditional upon any returned wine being collected in original saleable condition.Product warranties: WeLoveVino warrants that product supplied is of merchantable quality when delivered. Subject to applicable law, WeLoveVino does not make any other warranty or representation about products on offer. In respect of any statutory warranty that WeLoveVino cannot exclude, subject to applicable law, WeLoveVino's liability is limited, at its option, to the replacement or re-supply of the products or a refund of the cost of the products.

Notices to WeLoveVino: To notify WeLoveVino, call on 02 9114 6055 during 8 am-5 pm EST Monday to Friday, excluding public holidays) or email to support@welovevino.com.au.Notices to visitors: WeLoveVino may notify a visitor to the website by email, a general notice on the website, or by other reliable method to an address previously provided to WeLoveVino by the visitor.

Governing laws

Force majeure: WeLoveVino is excused from performing its supply obligations where and so long as prevented from doing so by reason of events beyond its reasonable control. WeLoveVino will endeavour to notify the buyer of the delay and its expected duration. If so prevented for longer than a reasonable time, WeLoveVino may elect to cancel the order without liability to the buyer.

Gift Cards: If WeLoveVino issue a buyer a Gift Card to redeem against the future purchase of wine or to redeem at any of our partnering restaurant, the terms and conditions on that Gift Card apply and bind the holder of the Gift Card. Gift Cards are non-transferable and may not be redeemed for cash.

Warning: WeLoveVino recommends that alcohol only be consumed in moderation. A case of wine is heavy, so extra care should be taken when lifting it. If you are concerned about the weight, transfer bottles 1 or 2 at a time. Red wine in particular may cause staining if spilt.

What information do we collect?
